Chapter 11 Reorganization Website
On October 3, 2008, Sleep Innovations, Inc., Comfort Co., Inc., Advanced Innovations Central, LLC, Advanced Innovations East, LLC, Advanced Innovations West, LLC, Advanced Urethane Technologies, Inc., AUT Brenham, Inc., AUT Dallas, Inc., AUT Lebanon, Inc., AUT Newburyport, Inc., and AUT West Chicago, Inc. (the "Debtors") filed voluntary petitions for reorganization under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware.
On November 21, 2008, the Bankruptcy Court entered an order (the "Bar Date Order") establishing January 15, 2009, at 5:00 p.m. prevailing Eastern Time, as the deadline for general creditors to file proofs of claim (including claims under section 503(b)(9) of the Bankruptcy Code) against the Debtors and April 1, 2009, at 5:00 p.m. prevailing Eastern Time, as the deadline for governmental units to file proofs of claim against the Debtors. On November 26, 2008, the Debtors filed their Joint Plan of Reorganization and their Disclosure Statement. On December 18, 2008, the Debtors filed their First Amended Joint Plan of Reorganization and their First Amended Disclosure Statement. Following a hearing before the Honorable Mary F. Walrath, an Order was entered on December 29, 2008, approving the First Amended Disclosure Statement (the "Order Approving the Amended Disclosure Statement") and setting February 4, 2009, at 10:30 a.m. for the hearing to consider confirmation of the Debtors' First Amended Joint Plan of Reorganization (the “Confirmation Hearing”). On February 4, 2009, Findings of Fact, Conclusions of Law and an Order (the “Confirmation Order”) were entered confirming the Debtors’ First Amended Joint Plan of Reorganization.
